Your numeric character references are wrong.  In XML, numeric character
references do not work the way they did in HTML generation 1-4 browsers.
They give the Unicode number. So ’ is the Unicode character U+0092
which is a control character (in the C1) range.

Now 146 is the code point in the extended characters sets used on Windows
platforms. This are sometimes, spuriously, called the "ANSI" character sets,
but better known as CP1252, or Western European DOS.

So to make your data correct, the first thing you must do is to generate the
numeric character references using Unicode numbers. Then work out
the solution from there.  If sometimes ’ works, it is only by
a happy accident, in that your system is misconfigured compatibly all the
way through. But it is not robust or reliable. 

If your file is in CP1252, then you should label the XML with the appropriate
encoding header. But that will not change how character references are 
interpreted: they are always Unicode. And if you want CP1252 output,
use the appropriate output statement in XSLT.
