Hess,
  It sounds like the non-determinisic restrictions of WXS are a problem
here.  Since you can't use RELAXNG, another option would be to just live
with the <any> wildcard in the WXS schema.  Then use Schematron or other
processing logic to guarrantee that your 'specified element' is present.
 
   WXS, or any one particular schema language, for that matter, can't do
everything.   
Get over it.  :)

The XML document for which I have to write the schema have all the elements
under the section metadata as illustrated in my sample and should accept any
others element from the same namespace or from a other name space. I can not
change this requierement. 

Any others idea ?

Perhaps in your app the xs:any element can be restricted by
namespace="##other", removing the indeterminacy. Jeff
