If you look inside xml.dcl shipped with SP you will see that this is 
limitation of SP parser package:

   -- use this instead of the official declaration because SP only
                 supports 16-bit characters --
                 160     65374   160
                 65534   2       UNUSED
              -- 55296   2048    UNUSED
                 57344   8190    57344
                 65534   2       UNUSED
                 65536   1048576 65536 --

You can use different parser for validation, e.g. Xerces or xmllint.
