In furtherance of Dr. Leff's useful literature search, I also bring to your collective attention the following statement addressed to the US Department of Commerce with regard to a proposed deletion of the ESign provisions which currently excepts wills from the coverage of the law, including the technology-neutral provisions. The statement, dated December 3, 2002 and authored by a Utah professor includes a review of the Utah eNotary Act in the context of its Digital Signature law, which is somewhat different from the provisions discussed by Dr. Leff.
