It would seem preferable to completely discard the <define name="xmldsigMarkup"> schema element and replace the <ref name="xmldsigMarkup" /> element with something that indicates no definition is being provided.

The comment from the the first sentence of Part 3 cd01 section 4.3 seems appropriate at that place.

In addition, it would be worthwhile to reference Part3 cd01 section 4.3 with a comment concerning how relative URIs are to be interpreted.
