| This fragment appears to be a valid, well-formed HTML document but

It is not a valid HTML document, simply because it has no DOCTYPE
declaration. This makes it impossible for an SGML parser to infer the
document element type as well as the omitted tags.

Wqell-formed does not apply to HTML, although the newest SGML TC has
some terms that are more or less equivalent (although finer-grained)
with well-formed.
 
| HTML, which has an SGML DTD, allows both the HTML and BODY tags to
| be optional.

It does, but TITLE is required (and missing in this document). So even
with a DOCTYPE this would still be invalid.
