Certainly and since Ken already did most of the job for you a schematron
schema could look like:
<schema xmlns="http://www.ascc.net/xml/schematron">
<pattern>
<rule context="*">
<report test="following-sibling::*[name(.)=name(current())]"
>There can only be one <name/> element at the same level.</report>
</rule>
</pattern>
</schema>
