Of course he can.  But MS, Sun etc. will do as they 
do with MPEG:  pay the fees.  You will be the one 
who can't afford that, but it won't be lawyers, 
MS or any of the traditional webBogeymen who 
have frustrated you:  it will be a lone hacker.

Somehow, I find this methodology unconvincing. This isn't war, it's finance.
In war, anything goes.  In finance, anything the court will approve goes.
Microsoft, Sun, et al will not be able to prevent Mr. Northrup from
contacting those with money to invest by force of arms. If he has an asset
worth billions, wouldn't he be willing to trade, say, one percent of that
asset for a few paltry millions (a discount, to be sure) to ensure that he
has the resources to withstand the onslaught of "corporations and
communities"?
