Umm, if you read carefully, you'll note that this is not a "New W3C Patent
Practice" -- it's a "New" description of *current* W3C patent practice,
before the addition of RAND licensing by the Patent Policy Working Group.

Think of it as DOM Level 0.  This is the baseline, that xml-dev likes,
that will be changed to something xml-dev doesn't like.
