Noting that, under the new Regulation, computer programmes will be excluded from
patentability, it declared that patents already granted by the EPO could be
annulled by either national courts or the European Court of Justice.
Indeed, the Commission's stance reflects reality. In recent months Poland's
patent office has refused to grant two patents to software protected by the EPO,
while the High Court of England and Wales ruled that two more granted by the EPO
were invalid on UK territory.
