My understanding is that UTF-8 can have a BOM (EF BB BF), and XML allows it 
to be used.  However, if there is no BOM, then, despite the additional 
diagnosis offered by XML: F.1 Detection Without External Encoding 
Information, it must be considered a fatal error.

I'm not sure why this should be!
