​There is no 'situation'. The ambiguity has been recognized, fixed in the latest version and published. 
Just like every other bug fix in any software. 

Upgrading to use 1.1 is not a big deal. ​ 
As far as I know all you need to do is set the minimum version to 1.1 to tell the processors which version to validate against. 

But, this is not spelled out exactly in the spec (as I recall) however, there is a convention established for this by both Saxon and Xerces.
