PRD02 Pt 2, escaping quotation marks

Dear all,

In 5.4 we are told

"XML escaping rules apply: thus inside an XML attribute double-quote characters shall be escaped."

But XML like:

<e a='"Damn", said the duchess'/>

Is conformant. Why re-state XML provisions and risk (as here) misrepresenting them?
