Actually as I was sitting here I realized that there cannot be any
case in which ##local is under ##other since other needs to qualified,
and local cannot be qualified, this is probably what you were trying
to tell me. So I suppose that Ken's example was not non-deterministic.

Although isn't it the case that the empty namespace can be qualified
in XML Namespace 1.1? doesn't really apply to anything we need to
worry about though.
