You may be right about the protocol, but the courts didn't
kill napster. They put themselves out of business by breaking
the law. What stops people from using the protocol?

Just use whatever suits your mood.
Look at it this way -- if the court hadn't killed Napster, I have no doubt
we'd be using their protocol to do web services, not SOAP or XML-RPC.
Think about that!
