Yes, and I agree with you that having automatic transformation of the
document before XSLT sees it is unhelpful, but I think that you need to
argue that it is this XML requirement that is being broken not anything
in XSLT. Even if an XSLT engine is in practice closely tied to a
particular XML parser, the model is that XSLT has no control over this
and just gets whatever it gets from the parser.
