Sorry David,
This is still non-deterministic because when the parser encounters a
description element, it does not know which branch of the content model
to take. I think what you want is:

<xs:sequence>
<xs:element ref="description" minOccurs="0"/>

> <xs:sequence>
> <xs:element ref="earliestdate"/>
> <xs:element ref="latestdate" minOccurs="0"/>
